Motions to Dismiss

Motions to Dismiss are filed in cases under certain circumstances. One circumstance is when both the State and the Defendant agree upon all the facts in a case, and the Defendant argues that those acts do not constitute a crime. This is commonly referred to as a “c-4 motion”. As you can imagine, the State and Defense rarely agree completely on the facts of a case and, as a result, these motions are not very common.
